Can you bring recreational marijuana on your Florida vacation?

May 28, 2025 | Drug Offenses

You’re planning on traveling to Florida over the summer to visit your relatives who live there. You live in a state where recreational marijuana is legal, and you use it regularly. What you’re wondering is if you can bring some of those products with you on your trip to Florida, or if you’re going to run into problems—even though you purchased those products legally at home.

To start with, it’s worth noting that adult-use recreational marijuana products are not legal in Florida. If you bring them with you, despite the legality of the purchase in your home state, you’re still violating the law in Florida. You could be arrested and fined or charged.

Crossing state lines

The second thing to remember is that you may have to cross numerous state lines as you travel to Florida. This is also illegal with marijuana products in your possession. Technically, crossing a state line makes this a federal crime. Federally, marijuana is still prohibited in every state. This likely doesn’t have much effect on you at home, where these products are legal under state law, but it’s important to know that the federal laws are much different.

Additionally, you cannot fly with marijuana products. If you try to board a plane and you’re found with them in your possession, then you could face legal charges.

Navigating the defense process

If you are facing drug charges, especially if you didn’t even realize you were violating the law, you need to know about all of the defense options you have as you work your way through the legal process.
