Synthetic cannabinoid charges in Florida

Popularly known in Florida as K2 or spice, synthetic cannabinoids are often sold as potpourri or incense in various stores. If you are charged with possessing synthetic cannabinoids with the intent to sell them, the consequences could be serious if a conviction is obtained.

K2 is made from chemicals that have now been classified as schedule 1 drugs. If you are convicted of possessing schedule 1 drugs with the intent to sell them, you may face a mandatory prison term that can last for years along with a substantial fine. If you are charged in federal court with a schedule 1 drug offense, you may also face simultaneous state charges.

In some cases, prosecutors overcharge people who are caught with synthetic cannabinoids. If you did not possess the K2 with the intent to sell it, you will need to be able to show that a sales charge is inappropriate. In other cases, the police officers may have used tactics that are not constitutional in the manner in which they searched you or your property. If that is the case, you may be able to argue for suppression of the evidence against you.

The attorneys at the law firm of Obrien Hatfield PA regularly represent people who are facing drug charges in both state and federal court. They review our clients' cases carefully to determine whether or not they may have been charged with a crime that they did not commit. They also analyze how the investigation, stop, search and seizures were conducted. If they find that something was done improperly, the challenge the admissibility of the evidence against our clients. If you are currently facing charges of possessing synthetic cannabinoids with the intent to distribute them, you might want to review the information that we have compiled on our K2 trafficking page.
